1. Who we are

ТОВ «ЛК Енерджи Груп» (hereinafter — "LK Energy", "we", the "Company") is a developer and contractor of projects in solar power engineering, electrical equipment and grid infrastructure.

The data controller of personal data within the meaning of the Law of Ukraine "On Personal Data Protection" (Law No. 2297-VI) is LK Energy.

2. What data we collect

2.1. Data you provide yourself through forms on the website (contact form, quote request, job application form):

first and last name;
phone number;
email address;
company name (if applicable);
message text and attached files.

2.2. Data collected automatically:

IP address (in server logs — for up to 30 days for security purposes);
browser type, OS, language, screen resolution;
pages you viewed, referral source, session duration;
cookie identifiers (with your consent).

2.3. Technical form-protection measures: to counter automated (bot) submissions, the website uses built-in technical measures (a hidden honeypot field and IP-based rate limiting for submissions). These measures do not transmit your data to third-party services.

3. Legal grounds for processing

Consent: (Art. 11 of the Law of Ukraine "On Personal Data Protection"; Art. 6(1)(a) GDPR for visitors from the EU) — for marketing cookies, analytics, mailings.
Performance of a contract or pre-contractual measures: (Art. 6(1)(b) GDPR) — when you request a commercial proposal or enter into a contract.
Legitimate interest: (Art. 6(1)(f) GDPR) — website security, protection against spam/bots, anti-fraud.
Legal obligation: retention of accounting and tax documents.

5. Cookies and Google Consent Mode v2

The website uses cookies of three categories:

Necessary: always active, ensure the website functions;
Analytics: (Google Analytics 4, Google Tag Manager) — only with your consent;
Marketing: (Google Ads, remarketing, advertising performance measurement) — for visitors from the EU/EEA, the United Kingdom and Switzerland only with your consent; for visitors from Ukraine and other countries — by default, with the option to opt out.

We use Google Consent Mode v2. For visitors from the EU/EEA, the United Kingdom and Switzerland, Google tags operate in a non-identifying mode until consent is obtained (ad_storage=denied, analytics_storage=denied). For visitors from Ukraine and other countries, analytics and advertising cookies are enabled by default (analytics_storage=granted, ad_storage=granted), and you may opt out at any time. You can manage consent via the banner or the "Cookie Settings" link in the footer.

6. Third parties we share data with

Our own Payload CMS (on our own server and database) — storage and processing of submissions from website forms;
Cloudflare, Inc. — network delivery and website protection (CDN / proxy);
Google Ireland Ltd. (Google Analytics 4, Google Ads, Tag Manager) — web analytics and advertising; for visitors from the EU/EEA, the United Kingdom and Switzerland — only with your consent; for other regions — by default, with the option to opt out;
government authorities — upon their lawful request.

Transfer of data outside Ukraine is carried out on the basis of the European Commission's standard contractual clauses or equivalent safeguards.

Sharing contacts with advertising systems

If you submitted a form or contacted us, we may share your contact details (phone number, email address) with advertising systems — Google Ads and similar — in order to show you our ads or, conversely, to exclude you from them. Contacts are shared in encrypted form only: instead of the number or address itself we send an irreversible code from which the original data cannot be restored. The advertising system matches this code against its own and deletes it after matching.

We do this so as not to advertise to people who are already our customers, and to show you the same ads less often. The legal basis is our legitimate interest in conducting business (Art. 11 of the Law of Ukraine "On Personal Data Protection"), and for visitors from the EU — your consent (Art. 6(1)(a) GDPR).

You can opt out at any time — write to info@lk-energy.com.ua and we will remove your contacts from all advertising lists within 30 days.

7. Your rights

Under the Law of Ukraine "On Personal Data Protection" and the GDPR, you have the right to:

know about the fact and content of the processing of your data;
obtain a copy of your data (right of access);
request correction of inaccurate data;
request erasure ("right to be forgotten");
restrict processing;
data portability;
withdraw consent at any time;
lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights (ombudsman.gov.ua, tel. +38 044 253-7403), or, for EU residents, with the relevant national supervisory authority.

8. Security

We apply organizational and technical measures: HTTPS, security headers (HSTS, CSP, X-Frame-Options, X-Content-Type-Options), role-based access control, logging, backups, and staff training.

Analytics cookies and consent geography

To understand how visitors use the site, we use Google Analytics and Microsoft Clarity. If you visit from the EU/EEA or the United Kingdom, analytics cookies are enabled only after your explicit consent in the banner (GDPR/UK GDPR). For visitors from Ukraine and other countries, analytics cookies are enabled by default, in line with applicable Ukrainian law; an informational notice is shown on your first visit. You can change your choice or disable analytics cookies at any time via “Cookie settings” at the bottom of the page. We use Google advertising cookies (ad_storage, ad_user_data, ad_personalization) to measure the performance of our own advertising in Google Ads — to see which ads bring enquiries — and to build advertising audiences and run remarketing. For visitors from the EU/EEA, the United Kingdom and Switzerland they are enabled only after explicit consent in the banner. For visitors from Ukraine and other countries they work by default; you can opt out at any time via “Cookie settings” at the bottom of the page — choosing “Necessary only” disables both analytics and advertising cookies.
